Terms of Service — The Cunning Linguist

Plain English first: Use the platform to learn languages. Don't misuse it, don't try to break it, don't scrape or redistribute the course content. We provide the service in good faith; please use it that way.

1. Acceptance of terms

By accessing or using The Cunning Linguist ("the Service," "the Platform"), you agree to these Terms of Service. If you don't agree, please don't use the platform. These terms form a binding agreement between you and The Cunning Linguist.

We may update these terms from time to time. If we make material changes, we'll notify registered users by email. Continued use after changes take effect means you accept the updated terms.

2. Who can use the service

You must be at least 13 years old to use The Cunning Linguist (16 in certain jurisdictions where a higher age threshold applies under applicable law). By using the platform, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these terms on your behalf.

3. Your account

You may use the core platform as a guest — no account required. If you create an account, you are responsible for:

Keeping your login credentials confidential
All activity that occurs under your account
Notifying us promptly at hello@cunninglinguist.app if you believe your account has been compromised

One person, one account. Creating multiple accounts to circumvent limits or restrictions is not permitted.

4. Free access and premium services

The Cunning Linguist currently provides its core content — 30-day lesson plans, flashcards, conversation scenarios, and quizzes — free of charge. We reserve the right to introduce premium features, subscriptions, or one-time purchases in the future.

If and when paid features are introduced, the specific terms, pricing, and refund policies for those features will be disclosed at the time of purchase. Free features will remain free unless we provide reasonable advance notice of any change.

5. Acceptable use

You agree not to:

Scrape, copy, redistribute, or sell any course content, vocabulary data, conversation scenarios, or other materials from the platform
Reverse-engineer, decompile, or attempt to extract the underlying source code or data structures of the platform
Use automated tools, bots, or scripts to access the platform in a way that places unreasonable load on our infrastructure
Attempt to gain unauthorized access to any part of the platform, other user accounts, or our servers
Use the platform for any unlawful purpose or in violation of any applicable laws
Harass, impersonate, or harm other users
Transmit any viruses, malware, or other harmful code

We reserve the right to suspend or terminate any account that violates these terms, at our sole discretion.

6. Intellectual property

All content on The Cunning Linguist — including lesson plans, vocabulary sets, conversation scenarios, audio recordings, mascot characters, design, and code — is owned by or licensed to The Cunning Linguist and is protected by copyright and other intellectual property laws.

You are granted a limited, personal, non-transferable, non-exclusive license to access and use the platform for your own language learning purposes. This license does not include the right to download, copy, redistribute, sublicense, or create derivative works from any platform content.

The Cunning Linguist name, monocled gentleman mascot, and associated logos are trademarks of The Cunning Linguist. You may not use them without prior written permission.

7. User-generated content

The platform does not currently include user forums, chat, or public content submission features. If we introduce such features in the future, these terms will be updated to address user-generated content at that time.

8. Advertising

The Cunning Linguist may display third-party advertising on the platform. By using the service, you acknowledge that advertising may appear. We will aim to ensure ads are appropriate for a general audience. We are not responsible for the content or accuracy of third-party advertisements.

9. Third-party links and services

The platform may contain links to third-party websites or integrate with third-party services (such as Google for authentication). We are not responsible for the content, privacy practices, or terms of those third parties. Following any link to a third-party site is at your own risk.

10. Disclaimer of warranties

The Cunning Linguist is provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. Language learning outcomes depend on your own effort and practice — we make no guarantees about fluency or specific results.

11. Limitation of liability

To the fullest extent permitted by applicable law, The Cunning Linguist and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these terms or your use of the platform shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) $100 USD.

12. Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction in those courts.

13. Termination

You may stop using the platform and delete your account at any time. We may suspend or terminate your access at any time for any reason, with or without notice, including for violations of these terms. Upon termination, your right to use the platform ceases immediately.

Sections 6 (Intellectual property), 10 (Disclaimer of warranties), 11 (Limitation of liability), and 12 (Governing law) survive any termination.
